Hi All,
I just had a debate with someone on another website who made it a point to ask me something I did not appreciate.
This is what I understand to be so. The 10 year divorce rule for a divorce spouse does not count if that spouse is disabled for survivorship benefits. This person asked me if I thought it should be that a 22 year old person can collect on her ex's husband's Social many years later after only being married for a short time. First of all I told her, a 22 year old who is disabled on SS check would get more in her own disablity check than her ex husband earnings at the time of their divorce would give in as a survivor. This is my understanding that that SS will not pay out survivorship benefits if the SS check the survivor is alreayd getting is greater. If the survivor remarries then she no longer qualifies. The survivor also has to be over 50.
I've done my homework in this as this is what I am fighting for. Just like I've done my homework on other things my lawyer has not been doing for me. I've come to find out that I am the only one I can depend on and need to always prepare myself. _________________

Barb I titally understand this. I wouldn't get anything from my X husbands stuff anyway but am from my own SSD I am now disabled and have enough work time to get something even though it isn't much. *shrugs*... I agree with you totally _________________

Thanks all.
After reading the long version of the Social Security law on this topic it seems I do have to be married for 10 years even if I'm disabled. It is a bit comfusing though as why would they even mention that if your disabled you can get it if you can get it without being disabled after being married for 10 years? Oh well, I tried. _________________
